What is PERM and what are the requirements?
The acronym PERM stands for Program Electronic Review Management. It is the Department of Labor’s newest process for ensuring that American businesses exhaust every resource to find qualified American workers before turning to overseas sources for recruiting workers. PERM was officially put in place on March 28, 2005.
What is required?
Prior to hiring a non-U.S. worker to fill a vacant job opening, employers must prove that an active search and recruitment process took place to find qualified U.S. workers who can either immediately fit the need or who have demonstrated potential to be fully trainable.
- Under PERM rules, an employer is required to pay a minimum of 100% of the prevailing wages to any non-U.S. worker hired to fill a job.
- PERM rules must be followed for all labor certification applications filed on or after March 28, 2005.
- PERM labor certifications are to be filed electronically or by mail to the DOL and must be updated annually.
